Frequently asked questions
-
If you are being sued by a debt collector and do nothing, it is highly likely that the debt collector will file for a Default and attain a judgment against you. After attaining a judgment, the debt collector can seek a garnishment or an attachment.
-
A garnishment lets a creditor take your money or assets which are in the hands of someone else. For example, garnishing wages you are owed by your employer.
An attachment lets creditors, with the help of a constable or sheriff, take your personal belongings or money and sell them to pay off your debt.
-
Yes. NRS 21.090 provides a list of income and assets which a creditor cannot take to pay a judgment. Below are a few examples (list is not exhaustive, see NRS 21.090 for the complete list):
75% of a person’s take-home pay, or 82% of your take-home pay if you make less than $770 per week.
Personal property not to exceed $10,000.
A tax refund derived from earned income tax credit.
Veteran’s Benefits; Social Security (SSI); Welfare benefits; Unemployment benefits; Worker’s compensation benefits.
Certain federal and state retirement accounts.
One vehicle, if your equity is less than $15,000, unless the lawsuit you lost concerned the loan for the vehicle.
A homestead house, up to $605,000 of the home’s value.
-
Yes. If you decide to defend the lawsuit yourself, make sure to follow all court procedures and local rules of practice. For further resources you should visit the Civil Law Self Help Center.
